CLEAR OFFICE PRIVACY POLICY
Purpose
Clear Office (“Clear Office” or “We”) respects your privacy and are committed to protecting it through our compliance with this policy. This privacy policy describes: (1) the types of information we may collect or that you may provide whenever you purchase, download, install, register, access or use the Clear Office mobile device application (the “App”); and (2) our practice for collecting using, maintain, protecting, and disclosing that information.
Please read this Privacy Policy in full to understand our policies and practice regarding your personal information and how we will use it. If you do not agree with our policies, do not download, register with, or use the App.  By downloading, registering with, or using the App, you agree to this privacy policy.  This policy may change from time to time, and those changes will be posted here with a new Last Modified date.  If you have any questions about this policy, you may contact us inquiry@clear-office.com.  Your continued user of the App after we revise this policy means that you accept those changes, so we encourage you to check the policy periodically for updates.
DISCLAIMER: By downloading, registering for, or using our App, you consent to our collection and use of your information as described in this Privacy Policy.  If you are accessing the App outside of the United States of America, read this notice now.
Information You Provide to Us
When you download, access, and use the App, we may ask you to provide information:
·         Voluntarily – When you download, register with or use our App you will be asked to provide information voluntarily.  Certain features on our App may ask you to provide your personal information voluntarily.  For example, we ask for information by which you may be personally identified such as name, postal address, email address telephone number. As another example, to post an item listing (“Listing”) on the App, you will provide a description of the item and photo(s) of the item to be listed.  This information also includes information that you provide by filling in forms in the App and accessing the marketplace on the App.
·         In Connect with a Report – When you initiate a report with us to notify us about a problem with the App, you may provide information including personal information, and records and copies of your correspondence (including email address and phone number) may be maintained if you contact us.  We may also retain your responses to surveys that we might ask you to complete for research purposes. 
Automatically Collected Information
When you download, access, and use the App, it may use technology to automatically collect:
·         Usage Details – When you access and use the App, we may automatically collect certain details of your access to and use of the App, including traffic data, location data, logs, and other communication data and the resources that you access and use on, or through, the App.
·         Device Information – We may collect device-specific information (such as the type of mobile device you use, your mobile device’s unique device identifiers, operating system version, the IP address of your mobile device, mobile network information including phone number, and information about the way you use the App.)
·         Stored Information and Files – The App also may access metadata and other information associated with other files stored on your device. This may include, for example, photographs, audio and video clips, personal contacts, and address book information.
·         Location Information – This App collects real-time information about the location of your device.
If you do not want us to collection this information, do not download the App; if downloaded, you can delete the App from your device at any time.
How We Use Personal Information Collected from Our App and Why
Clear Office may use information we collect from our App, including information that you provide to us to: (1) allow you to use the online marketplace on our App; (2) inform you about our services and send marketing communications; (3) respond to your requests for information; (4) allow you to post and respond to ads for Listings; (5) invite you to upcoming events and; (6) to improve our App quality, offerings and capabilities.

We use information that we collect about you or that you provide to us, including any personal information, to:
·         Provide you with the App, its contents and features, and any other information that you request from us;
·         Fulfill any other purpose for which you provide the information;
·         Carry out our obligations and enforce our rights arising from any contracts entered into between you and us, including for billing and collection;
·         Notify you about your account;
·         Notify you when updates are available for the App, and of changes to the marketplace we provide on our App.
The usage information we collect helps us to improve our App and to deliver a better and more personalized experience to users by enabling us to:
·         Estimate our audience size and usage patterns;
·         Store information about your preferences, allowing us to customize our App according to your individual interests;
·         Speed up your searches;
·         Recognize you when you use the App.

Clear Office may disclose personal information:

·         For any other reason with your consent or at your direction to use your information in a particular way.
Information You Must NOT Provide on this App
·         Do NOT provide sensitive personal information about yourself or anyone on our App.  For example, the only information you will be asked to provide is: email, phone number, address, and details on your product you are selling. You will never be asked to provide information such as your social security number, your date and place of birth or medical information on our App.  Our App is not directed or intended to collect this type of sensitive personal information.  Especially due to the nature of our platform as a social marketplace, we strongly encourage you not to disclose sensitive information on our App.
·         Do NOT provide any personal information on our App if you are a child under the age of 16.  Our App is not intended for or directed to children under the age of 16. We will not knowingly collect information, including personal information, from children.  If we obtain actual knowledge that we have collected personal information from someone under the age of 16 without verification or parental consent, we will take steps to promptly delete it.  If you believe that we have mistakenly collected information from a person under the age of 16, please contact us at inquiry@clear-office.com
 
Notice to Persons Accessing Our App Outside of the United States of America (USA)
If you download, register, access or use our App outside of the USA, any information you provide to us on the App will be transferred out of the country you have accessed the App from and into the USA.  If you do not want your personal information to leave the country you have accessed the App from, do not download, register for, or use the App.  When you download, register, or provide personal information to Clear Office, you explicitly consent to the transfer of your information to the USA.
Please note that this App was designed specifically for persons in the USA.  As such, Clear Office intends for its Privacy Policy to be governed only by the laws of the United States of America.
California Consumer Rights Under the California Consumer Privacy Act (“CCPA”)
Under the California Consumer Privacy Act (“CCPA”) you may have certain rights which apply to the information we collect through our App or which we collect from our users.  These rights include:
·         Right to Know About Personal Information Collected, Disclosed, or Sold.  A consumer of a covered business has the right to request that a business covered under the CCPA disclose what personal information it collects, uses, discloses, and sells of the consumer. 
·         Right to Request Deletion of Personal Information.  A consumer of a covered business has a right to request the deletion of their personal information collected or maintained by a covered business.
·         Right to Opt-Out of the Sale of Personal Information. A consumer of a covered business has a right to opt-out of the sale of their personal information by that business.
·         Right to Non-Discrimination for the Exercise of a Consumer’s Privacy Rights.  A consumer of a covered business has a right not to receive discriminatory treatment by that business for the exercise of the privacy rights conferred by the CCPA.
·         Authorized Agent.  A consumer of a covered business can designate an authorized agent to make a request under the CCPA on the Consumer’s behalf through a written instrument, signed and acknowledge before a licensed notary public.
If you want to exercise your rights under the CCPA, you may contact us and make such a request via email at inquiry@clear-office.com  or by mail to our designated Privacy Officer at 1821 Campbell Ave, San Jose, CA 95125.  If we are unable to comply with your request within 45 days, we will contact you and let you know whether we can complete your request or whether we need more time or information in order to complete your request.  You may be required to first provide certain authenticating information before we can complete your request.
Due to the nature of our services and the purpose of the collection, some personal information may be protected by attorney-client privilege, trade secret, or another privilege and thus we may be unable to disclose it.  
We May Modify Our Privacy Policy
We may modify our Privacy Policy from time to time to reflect changes in our practices or services or in response to changing legal or regulatory requirements.  The updated Privacy Policy will be posted on our App and will include the date it was last modified at the top of the policy after “Last Modified.”  We encourage you to regularly visit the privacy policy each time you visit.
